Scott Stapp has apparently missed a court-ordered hearing where he was to discuss a possible stint in a Florida psychiatric hospital for mental evaluation and drug treatment.

GossipExtra reports that a Palm Beach County sheriff's deputy served Stapp a summons at a Holiday Inn Express in Boca Raton, where the Creed frontman is believed to be living. Stapp never appeared at the Delray Beach courthouse.

“There’s not much that can be done as far as bringing him to court,” a member of Stapp's camp is quoted as telling GossipExtra. “It’s a civil matter.” Authorities can, however, hold Stapp for contempt of court when he attends any subsequent proceedings. He also risks being involuntarily committed, a circumstance which wouldn't give Stapp the benefit of testifying on his own behalf.

Stapp returned to the news a couple of weeks ago when he posted a lengthy video detailing his plight, years after Creed scored Top 10 U.S. singles with 'Higher,' 'My Sacrifice' and 'With Arms Wide Open.' He claimed to be “completely penniless,” while splitting his time between living in a Holiday Inn and his truck.

Stapp’s estranged wife then reported that the singer was struggling again with drug issues. His bandmates have also been trying to reach out.

Jaclyn Stapp has since asked that her husband be held for psychiatric observation for 60 days. He'd been on a similar psych hold for some 72 hours earlier in November, after Madison County, Fla., police said they found Stapp on the side of the road appearing to be "wasted, incoherent and rambling that someone was trying to poison him."
